Terms of Service

These Terms of Service ("Terms") govern your use of bullseyeleadsolutions.com (the "Site") and the services provided Bullseye Lead Solutions ("Bullseye," "we," "us," or "our"). By using the Site, submitting information to us, or purchasing our services, you agree to these Terms. If you do not agree, please do not use the Site or our services.

If you sign a separate written agreement, proposal, or order form with us (a "Client Agreement"), that Client Agreement will control if it conflicts with these Terms.

Our Services

Bullseye builds and manages lead generation systems for consultants, fractional executives, advisors, and other professional service providers. Our services may include custom landing pages, paid advertising campaigns, AI-assisted outreach and follow-up, appointment scheduling, and related marketing automation (the "Services"). The specific scope of your Services will be described in your Client Agreement or onboarding materials.

Eligibility

The Site and Services are intended for businesses and professionals. You must be at least 18 years old and able to enter into a binding contract to use them. If you use the Services on behalf of a company, you confirm that you have authority to bind that company to these Terms.

Onboarding and Client Responsibilities

To deliver the Services, we rely on information you provide. You agree to:

• Provide accurate, complete, and current information about yourself, your business, and your offer
• Respond to our requests for information, approvals, and feedback in a timely manner
• Keep your calendar availability up to date so meetings can be scheduled accurately
• Attend the meetings booked on your behalf, or cancel or reschedule them promptly
• Make sure your services, claims, and credentials are truthful and lawful
• Follow up with and handle leads in compliance with all applicable laws, including laws governing email, phone calls, and text messaging

Delays in providing information or approvals may delay your campaign launch.

Fees and Payment

Fees for the Services are set out in your Client Agreement. Unless your Client Agreement says otherwise:

• An initial setup fee is due when you sign up for the Services
• Monthly fees begin one month after your campaign launches. Launch happens after your funnel is built and approved, not on a fixed calendar date.
• Monthly fees are charged automatically to the payment method on file on a recurring basis until the Services are canceled
• Advertising spend is paid directly by you to the advertising platforms.

By providing a payment method, you authorize us and our payment processor, Stripe, to charge all fees when due. You are responsible for keeping your payment information current. If a payment fails, we may pause the Services until the balance is paid.

The setup fee is non-refundable once work on your funnel has begun. Monthly fees are non-refundable for any billing period that has already started, except where the law requires otherwise.

Cancellation

You may cancel the Services by giving us 30 days' written notice. Cancellation takes effect at the end of the notice period, and you are responsible for fees through that date. We may suspend or end the Services if you fail to pay, breach these Terms, or use the Services in a way that is unlawful or harms others. When the Services end, any active campaigns and automations we manage for you will be turned off.

No Guarantee of Results

We work hard to generate qualified leads and booked meetings, but results depend on many factors outside our control. These factors include your offer, your market, advertising platform performance, and how you follow up with leads. We do not guarantee any specific number of leads, meetings, clients, sales, or revenue. Any projections, examples, or past results we share are for illustration only.

Advertising Platforms and Third-Party Services

The Services rely on third-party platforms, including Meta, Google, LinkedIn, HighLevel/LeadConnector, Stripe, and messaging carriers. Your use of those platforms is subject to their own terms and policies. We are not responsible for platform outages, policy changes, ad rejections, account restrictions, or changes in advertising costs.

AI-Assisted Communications

The Services use AI-powered tools to communicate with prospects and schedule meetings on your behalf. We configure and monitor these tools, but automated communications may occasionally contain errors. You agree to tell us promptly if you notice anything inaccurate so we can correct it.

Intellectual Property

You keep ownership of your logos, brand assets, and other content you provide to us ("Client Content"). You give us permission to use Client Content to perform the Services.

Bullseye keeps ownership of its templates, systems, workflows, automations, prompts, processes, and know-how, including those used to build your funnel. Once all fees are paid, you may use the ad creative and landing page copy we created specifically for you. The underlying Bullseye systems and templates remain our property.

Unless you tell us otherwise in writing, we may identify you as a client in our marketing materials.

Leads and Data

Leads generated through the Services are delivered to you for your business use. You are responsible for how you use lead information after it is delivered, including following applicable privacy and communication laws. We handle personal information as described in our Privacy Policy.

Acceptable Use

You may not use the Site or Services to promote anything unlawful, deceptive, or misleading. You may not use them to send communications without proper consent, or to violate the policies of any advertising or messaging platform. We may refuse or stop any campaign that we reasonably believe violates these Terms or the law.

Confidentiality

Each party agrees to keep the other party's non-public business information confidential. Each party will use that information only as needed to perform under these Terms.

Disclaimer of Warranties

The Site and Services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the fullest extent permitted by law, Bullseye will not be liable for any indirect, incidental, special, consequential, or punitive damages. This includes lost profits, lost revenue, or lost business opportunities. Our total liability for any claim related to the Site or Services will not exceed the fees you paid us in the three (3) months before the event giving rise to the claim.

Indemnification

You agree to defend, indemnify, and hold harmless Bullseye and its owners, employees, and contractors from any claims, damages, or expenses, including reasonable attorneys' fees, arising from:

• Your Client Content
• Your services or offer
• Your handling of leads
• Your violation of these Terms or any law

Governing Law

These Terms are governed by the laws of the State of Maryland, without regard to its conflict of law rules. Any dispute arising from these Terms or the Services will be resolved in the state or federal courts located in Baltimore, Maryland, and you consent to the jurisdiction of those courts.

Changes to These Terms

We may update these Terms from time to time. When we do, we will post the updated version on this page and revise the effective date above. Your continued use of the Site or Services after changes are posted means you accept the updated Terms.

General

If any part of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce any provision is not a waiver of our right to do so later. You may not assign these Terms without our written consent.
